Chapter 7 Bankruptcy • Chapter 13 Bankruptcy
At Russo, Rosalina & Co., LPA we limit our practice to Chapter 7 bankruptcy and Chapter 13 bankruptcy. Under Chapter 7 bankruptcy, the debtor discharges nearly all debts while getting to keep most property such as cars and houses. Under Chapter 13 bankruptcy, the debtor obtains discharge after a period of time by completing a payment plan.
Our lawyers primarily help clients file for Chapter 7 bankruptcy. However, since new laws took effect in 2005, some people have not been allowed to file Chapter 7. A person must take a "means test" to determine his or her eligibility to file a Chapter 7 bankruptcy petition.
The different types of debt are treated differently in bankruptcy. It is relatively easy, for example, to discharge credit card debt through bankruptcy.
