Do I need a lawyer for the probate process in Ohio?

Probate is an area of the law dealing with wills and inheritances, and the granting of probate is the first step in the process of managing the deceased person's estate. Ohio law does not require a lawyer for the probate process. However, if you are the executor or the administrator of the deceased person's probate estate, it may be in your best interest to seek legal assistance.

What to expect during probate

If an estate holder creates a will, it will be authenticated and its instructions followed during probate. Probate is also used to determine how much an estate is worth and pay any taxes or other debts that an estate owes. For Ohio residents, state law will specifically determine how the probate process is conducted.
